We invite any not-for-profit group, club, school, organization or entity to use our Site. When you access the Site and Services, you become a member (“User”). All must be at least 18 years of age. Persons who are at least 13 years of age but under the age of 18 may only become a User and/or access the Site and Services with the consent of a parent or legal guardian. Accordingly, by accessing the Site and Services, you represent and warrant that you are at least 18 years of age or older, or are at least 13 years of age and possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, representations and warranties set forth in these Terms; otherwise, please exit the Site. If you are a parent or guardian of a child who is at least 13 years of age, but under the age of 18, and you give your child permission to use the Site and the Services, you hereby agree to these Terms on behalf of both yourself and your child. You further agree that you are solely responsible for any and all use of the Site and Services by your child regardless of whether such use was authorized by you.
Becoming a Group Leader
In order to take certain actions through the Site, such as creating a fundraiser, you may be required to create a User account and provide certain personal information, such as your full name, email address, and phone number. You must provide information about yourself that is true, current, and complete, and maintain and update such information to keep it accurate. It is a violation of these Terms to log in through a third party service using an account that does not belong to you or in violation of any applicable agreement with that third party service.
As a group leader, you may be given the option to select a display name for your fundraiser You agree not to select a display name: (a) belonging to another person or entity with the intent to impersonate that person or entity; (b) that violates the rights of any third party, including intellectual property rights and/or rights of publicity; or (c) that Grant Headquarters, in its sole discretion, deems inappropriate or offensive. You acknowledge and agree that you shall have no ownership or other property interest in your account, and you further acknowledge and agree that all rights in and to your account (but not in the personally identifying information associated therewith) are and shall forever be owned by and insure to the benefit of Grant Headquarters. Grant Headquarters reserves the right to refuse any request to create an account for any reason or no reason.
Eligibility Requirements for Fundraisers
The Site and Services may only be used to raise grant checks for not-for-profit groups, clubs, schools, organizations or entities that meet the following eligibility requirements and any other requirements described on the Site.
Additional Terms For Group Leaders
Creating and Operating a Fundraiser
A fundraiser that highlights the impact of a supporter’s donation is one of the most fundamental practices in successful fundraising. To effectively create and operate a Fundraiser, each Fundraiser will have one or more primary contacts, who will be referred to in these Terms as the “Group Leader,” and who shall be authorized to act on behalf of the group.
As the Group Leader, you will be responsible for identifying the specific group for which you would like to raise grant checks, determining your fundraiser goal, establishing the Fundraiser profile, and managing the Fundraiser.
By creating a Fundraiser, you represent and warrant that you are authorized to act on behalf of the group. Grant Headquarters reserves the right to require that you submit written proof of your authorization to act on behalf of the group of your Fundraiser. Grant Headquarters reserves the right to terminate any Fundraiser, withhold or refund any grant checks raised, terminate or suspend any User’s account, or take any other action it deems necessary, in its sole discretion, if it reasonably believes that any Group Leader does not have the requisite authority to act on behalf of the Group. You further represent and warrant that: (a) the Group meets the eligibility requirements set forth above; (b) that you are raising money for a cause or activity that is legal under all applicable federal, state and local laws and regulations; and (c) all donated grant checks will be used solely for the purpose(s) you have stated on the Site.
Disbursement of Grant Checks
In order for the Group to receive processed grants, the Group Leader must fully complete the information requested on the Request a Check screen. Grant Headquarters may send a check to the Group’s verifiable physical address. Subject to these Terms, grant checks will be issued at the beginning of each month, when requested by the group leader for accounts with at least a balance of $50. Accounts having balances under $50 will be disbursed at the beginning of the month following the end of the group’s fundraiser. Grant Headquarters is not responsible for any errors or omissions in the name, mailing address, or other information provided by the Group Leader or the Group.
Use of Grant Checks
As the Group Leader, you are responsible for ensuring that grant checks will be used only for purposes expressly disclosed on the Fundraiser profile page. You acknowledge that if Grant Headquarters makes a good faith determination that the information on the Fundraiser profile page is inaccurate or misleading, or learns that grant checks disbursed to the Group have not been used in accordance with the purposes stated on the Fundraiser profile page, Grant Headquarters has the right to require that the Group promptly refund the grant check to Grant Headquarters.
Additional Terms For Groups:
You acknowledge and agree that the Group Leader is authorized to operate the Fundraiser and to solicit donations on your behalf. If you become aware of an unauthorized Fundraiser operated on your behalf, please immediately notify Grant Headquarters.
If you cannot use the donations for the designated purpose, you will immediately notify Grant Headquarters, and return any grant checks received to Grant Headquarters. If a Group Leader account remains inactive for eighteen (18) consecutive months, Grant Headquarters may, in its sole discretion, withhold grant checks, issue a refund.
You further acknowledge and agree that Grant Headquarters shall not be liable to you for any claims arising out of any Fundraiser of which you are the designated Group Leader, including claims arising out of (i) any Fundraiser that fails to reach its funding goal; and/or (ii) any act or omission on the part of the Payment Processor, Grant Headquarters or the Group Leader.
Additional Terms For Contributors:
Grant Headquarters provides a platform that allows you to support Groups who conduct a Fundraiser on Grant Headquarters. You understand and acknowledge that, by making a donation through the Site, you authorize Grant Headquarters, through its Payment Processor, to process your donation and charge your credit card. You further understand and acknowledge that your donation made through the Site may be delivered to a partner 501(c)(3) charitable organization to facilitate the disbursement of a grant check to the Group. Your receipt for tax-deductibility purposes will list the partner 501(c)(3) charitable organization as the recipient of your contribution, rather than your designated Group.
You acknowledge and understand that your personal information will be provided to the partner organization and to your designated Group. Further, you understand and acknowledge that any grant checks held by the partner organization are that organization’s property, subject to that organization’s exclusive legal control, and that grant checks issued through the Site may only be used for charitable purposes and not for the benefit of the contributor or other impermissible private benefit. You understand and acknowledge that any donations you make through the Site are made at your own risk. Grant Headquarters makes no warranties that donations will be used for any particular purpose, and will not be held liable for the use or misuse of donations by any Group. You further acknowledge that, if Grant Headquarters determines, in its sole discretion, that a particular Fundraiser was conducted in violation of these Terms, or that it would otherwise be improper to disburse the grant checks of a particular Fundraiser to the Group, that Grant Headquarters may not disburse the donations received in the course of a particular Project to the Group because, for example, the Group is no longer accepting donations, is no longer in good standing with state or federal regulators, or is no longer participating on the Grant Headquarters Service. Grant Headquarters may, in its sole discretion, withhold funds, issue a refund, and/or disburse funds to an alternate Beneficiary as it sees fit.
Grant Headquarters uses the Dream Giveaway® platform where your donation is tax-deductible to the fullest extent of the law. Please consult your tax advisor as to the tax-deductibility of your donation.
Payment Processing The Site provides Contributors with the ability to make a donation to specific Fundraisers. Grant Headquarters has engaged the services of a third-party payment processor (“Payment Processor”) to process donation transactions.
You hereby agree that, for all donations, (1) you will not use an invalid or unauthorized credit or debit card or other payment method; (2) donations/payment transactions will be charged to the credit or debit card you use through the Payment Processor; and (3) all donations/payment transactions are final and non-refundable. You further consent to the Payment Processor’s terms, and agree that Grant Headquarters may directly process donations or engage additional third parties to facilitate the processing and disbursement of grant checks for the use of designated Groups. Groups agree to be bound by the Payment Processor’s terms for those designated to receive grant checks.
It is a violation of these Terms to create a Fundraiser or to upload or transmit any content or information that promotes hatred, violence, discrimination or stereotypes based on race, gender, ethnicity, sexuality, or religion, or that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or otherwise objectionable, or that may invade another's right of privacy or publicity, or that includes statements in support of, or in opposition to, any candidate for public office, or that is fraudulent or misleading with respect to the intended Group of the Fundraiser or the intended use of grant checks raised. Grant Headquarters reserves the right, in its sole discretion, to edit and/or remove any Fundraiser or any content uploaded or transmitted in connection with a Fundraiser that it finds to be in violation of these Terms.
Grant Headquarters does not endorse any Fundraisers on the Site, and does not actively monitor or review Fundraisers or User Content posted to the Site. Grant Headquarters merely provides a technology platform to allow fundraisers to connect with donors. While Grant Headquarters makes reasonable efforts to confirm that Fundraiser Groups meet Grant Headquarters stated Group criteria, Grant Headquarters makes no warranties or guarantees whatsoever as to any particular Group, including, but not limited to, whether a particular Group meets the stated Group criteria and/or whether the grant checks donated to any particular Group will be used in accordance with the states purpose of the Fundraiser.If Grant Headquarters becomes aware of a Fundraiser or User Content that Grant Headquarters determines, in its sole discretion, violates these Terms or may be fraudulent, misleading, offensive, illegal, defamatory, or infringes the rights, or threatens the safety, of others, or is otherwise objectionable, Grant Headquarters reserves the right, without notice and in its sole discretion, to edit and/or remove the Fundraiser or content in question.
Grant Headquarters makes the Site and Services available in order to provide a passive platform for Site users to create Fundraisers and make donations through the Site. By making the Site and the Services available, Grant Headquarters does not engage in charitable solicitation activities on behalf of its users. Grant Headquarters may provide technical support to users for the sole purpose of allowing them to access and use the Site, which support shall not include advising Group Leaders or Site users as to the content of their Fundraisers or otherwise assisting them in planning or managing their Fundraisers.
Children Under 13 This Site is intended solely for users who are thirteen (13) years of age or older. Any registration by, use of or access to the Site by anyone under 13 is unauthorized, unlicensed and in violation of these Terms. By using the Service, you represent and warrant that you are 13 or older and that you agree to abide by all of the terms and conditions of these Terms. In its sole discretion, Grant Headquarters may terminate your account, delete your account information and any content or information that you have posted on the Site, and/or prohibit you from using or accessing the Site, or any portion thereof, for any reason, at any time, and with or without notice to you, if it believes that you are under 13.
Notwithstanding any terms in these Terms to the contrary, if you are in a jurisdiction in which the minimum age permissible by law to use the Site is greater than 13, all references to 13 in this section shall instead be replaced with the minimum age permitted in your jurisdiction.
If you are between the ages of 13 and 17, reside in the state of California, and have registered for a Grant Headquarters account, you may request and obtain removal of content and information that you posted on Grant Headquarters services that you participated directly in. To request removal of such content and information, you must send an email to firstname.lastname@example.org that complies with the following: (i) the email must be sent from the email address associated with the Grant Headquarters account; (ii) the subject line of the email must say "Content Removal Request”; and (iii) the body of the email must include the user name of the Grant Headquarters account. Grant Headquarters will send you an email to acknowledge receipt of your content removal request. You must then send a reply email to Grant Headquarters’ acknowledgement email to confirm your content removal.
You are solely responsible for maintaining the confidentiality and security of your password on the Site, and are responsible for all activities (whether by you or by others) that occur under your password or account. You must notify us immediately of any unauthorized use of your account. Grant Headquarters will not be liable for any loss or damage arising in connection with any unauthorized use of your account. Grant Headquarters has the right to reclaim any display name for any reason.
You warrant that all text, images and other content you post or submit to the Site (“User Content”) is your original work and/or to the extent that the User Content includes any text, images or other content owned by a third party, you warrant that you are licensed to use and reproduce such content on the Site. You accept all liability for any issues that may arise from such User Content. Please do not submit any images or photographs for which you do not have a current model or property release, or for which you do not have the permission of a parent or guardian as required by law or a relevant educational organization that the subject attends, unless you are otherwise authorized to post such material.
By submitting and posting User Content to the Site, you grant to Grant Headquarters a perpetual, irrevocable, worldwide, royalty-free and non-exclusive license to use, modify, reproduce, publish, broadcast, display and distribute the User Content in any format, using any medium, for any purpose. In other words, you allow us to continue to display your contributions to the Site.
You will, if asked by a representative of Grant Headquarters, cease posting any User Content, and/or links to content, deemed offensive, misleading, objectionable, in poor taste or that violates these Terms.
You understand and acknowledge that any questions, comments, suggestions, ideas, feedback or other information that you submit to Grant Headquarters, whether via email or via a form provided on the Site are not confidential and become the sole property of Grant Headquarters, and that Grant Headquarters shall own the exclusive rights, including copyrights and any other relevant intellectual property, in the User Submissions.
